These Terms of Service ("Terms") govern your access to and use of the Box of Cats website at boxofcatsmusic.com (the "Site"), our music releases, merch store, Nine Lives Club subscription, and all related services (collectively, the "Service"). By using the Service you agree to these Terms. If you don't agree, please don't use the Service.
1. Who we are
The Service is operated by Box of Cats Music ("Box of Cats", "we", "us", "our"), based in Victoria, Australia. You can contact us at info@boxofcatsmusic.com.
2. Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction) to make a purchase or subscribe. By using the Service you confirm that you meet this requirement.
3. Purchases
Music downloads
- All prices are in Australian Dollars (AUD) and are processed by Stripe.
- Download links are issued after payment is confirmed and expire 24 hours after issue. You may request a fresh link via your member portal or by contacting orders@boxofcatsmusic.com.
- You purchase a non-exclusive personal-use licence to the audio files. Public broadcast, commercial sync, and redistribution require separate licensing — contact us before using.
Physical merchandise
- Stock is sold on a first-come, first-served basis. We reserve the right to cancel and refund any order if stock turns out to be unavailable.
- Shipping rates, delivery times, and country availability are listed on our Shipping Policy page.
- International buyers may be liable for import duties, taxes, and customs fees on arrival — these are not included in our prices.
Nine Lives Club subscription
- Nine Lives Club ("NLC") is a recurring subscription billed monthly or yearly via Stripe.
- Monthly subscriptions may be cancelled at any time and will end at the close of the current billing period. No partial refunds for cancellation mid-cycle.
- Yearly subscriptions are non-refundable but remain active for the full 12 months from the start date.
- Member benefits — including access to the members vault, free yearly tee (yearly tier), and discounts — apply only while your subscription is active.
- We may modify benefits or pricing for new sign-ups; existing subscribers will be notified of any material change.
4. Refunds
Refunds and returns are governed by our Refund Policy. Where required by Australian Consumer Law, your rights to a refund, replacement, or repair for goods that are faulty, not as described, or unsafe are not limited by these Terms.
5. Intellectual property
All music, artwork, photography, copy, and assets on the Site are © Box of Cats Music or our partner artists and licensed to us. You may not copy, reproduce, redistribute, perform publicly, or use any content commercially without prior written permission.
6. Acceptable use
You agree not to:
- Resell, redistribute, or share your member downloads or subscription access with anyone else.
- Reverse-engineer, scrape, or attempt to access non-public parts of the Service.
- Use the Service to host, transmit, or solicit unlawful content.
- Bypass paywalls, geographic restrictions, or other access controls.
We may suspend or terminate accounts that breach these terms without notice and without refund.
7. Privacy
How we handle your personal data is covered in our Privacy Policy.
8. Liability
To the maximum extent permitted by law, Box of Cats is not liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability for any claim related to the Service is capped at the amount you have paid us in the 12 months prior to the claim.
Nothing in these Terms excludes or limits our liability for fraud, death or personal injury caused by negligence, or any liability that cannot be excluded under Australian Consumer Law.
9. Changes to these Terms
We may update these Terms from time to time. Material changes will be announced via the Site or via email to subscribers. Continued use of the Service after a change constitutes acceptance.
10. Governing law
These Terms are governed by the laws of Victoria, Australia. Any dispute will be subject to the non-exclusive jurisdiction of the courts of Victoria.
